The Influence Of Globalization And Modernization On The Existence Of Balinese Cultural Law

Abstract
Globalization influences several aspects of life across nations, such as economic, cultural and political aspects. However, globalization also presents challenges to these aspects of life in each country. This study aims to determine the influence of globalization on the existence of Balinese cultural law (customary law). The research method used in this study was normative legal research. This study focused on the study of legal norms related to customary law amidst the current of globalization. The results of this study indicate that 1) globalization has both positive and negative impacts on the existence of Balinese cultural law (customary law). The existence of Balinese customary law does not become an obstacle in following existing progress because it has characteristics that can be applied in this era of globalization, such as religious, togetherness, concrete, traditional, dynamic, open, simple and deliberative. This makes customary law a bulwark against the influence of globalization. 2) Balinese cultural law (customary law) has a constitutional legal status and is strengthened through a juridical basis and protection. Balinese Cultural Law (Customary Law) is implemented through preventive and repressive protection.
