Legal Liability Of Developers In Sale And Purchase Agreements Between Buyers And Housing Developers Diamond Village Juanda (Dvj) In Sidoarjo Regency

Abstract

This article analyzes the liability of the developer of Housing Diamond Village Juanda (DVJ) in Sidoarjo for breach of contract in the Sale and Purchase Agreement. The purpose of this article is to analyze the developer's liability and legal remedies for aggrieved buyers. The research findings indicate that the developer is liable for breach of contract due to failure to fulfill obligations, based on the Civil Code, Law No. 8/1999 and Government Regulation No. 12/2021. Buyers may pursue litigation or non-litigation procedures. To prevent breach of contract, buyers are advised to verify the developer's permits before signing the PPJB.
