The Problems In Implementing Government Regulation Number 20 Of 2021 On The Control Of Abandoned Areas And Lands Declared As Land Directly Controlled By The State

Abstract

Land has strategic social and economic functions, so abandoned land cannot be left without a clear control mechanism. This article examines the implementation of Government Regulation Number 20 of 2021 concerning the Control of Abandoned Areas and Land, particularly the mechanism for determining abandoned land and its legal consequences for rights holders. The main legal issue lies in the incomplete regulation of legal protection for rights holders when land is declared abandoned and transferred into land directly controlled by the state. The findings show that Government Regulation Number 20 of 2021 regulates evaluation, warnings and determination procedures, but does not specifically provide an objection forum, evidentiary standards for rights holders, or remedies when the determination is later proven incorrect. Regulatory refinement is therefore required to maintain legal certainty, the social function of land and protection of land rights.
