Legal Analysis Of The Criminalization Of Prostitution Offenses Committed By Husbands Against Their Wives Study Of Decisions No.55/Pid.Sus/2025/Pn Lmg

Abstract

This study investigates a case in which a husband facilitated his wife’s involvement in prostitution, as documented in Decision No.55/Pid.Sus/2025/PN Lmg. Its primary aim is to explore how judges comprehensively evaluate all relevant factors before rendering a verdict and to examine the application of Indonesian law in addressing similar offenses. The research employs a juridicalnormative methodology, combining legislative analysis with a case study approach and is supported by data obtained from the Lamongan District Attorney’s Office as well as relevant legal literature. The findings reveal that the court based its ruling on the third alternative charge, as it was conclusively established that the defendant had intentionally and repeatedly enabled his wife to engage in indecent acts with others for financial benefit. In reaching this decision, the judges considered not only statutory provisions but also broader contextual elements, including societal consequences, prevailing moral values and the underlying objectives of criminal punishment. Although the legal process was carried out in accordance with procedures, there were still obstacles in the form of a lack of explicit regulations, difficulties in proving the case and low public awareness. Therefore, this study emphasizes the need for regulatory reforms and preventive measures to ensure that law enforcement is more effective and fair.
