Legal Certainty Of A Statement Of Release Of Land Rights Made By The Sub-District Head For Land Objects With A Certificate Of Ownership Rights Basis

Abstract

The legal certainty of a land title release letter from an individual to a legal entity issued by a sub-district head/PPATS for a certified land object is valid as long as it is issued in accordance with the authority and procedures. However, its implementation does not provide legal certainty due to legal loopholes that allow it to be transferred to another person, as it is not registered with the National Land Agency (BPN). The status of a land title certificate issued for a land title release from an individual to a legal entity is invalid as proof of ownership, because the transfer of rights through a sale and purchase is carried out unlawfully on land owned by another person. The role of a notary/PPAT in exercising their authority is to act professionally and refuse to issue an authentic deed when they learn that the land title has been previously released to a legal entity
