A Preventive Legal Approach To Disaster Mitigation In Plantation Systems Based On Sustainable Agriculture

Abstract

This study aims to analyze the effectiveness of implementing a preventive legal approach in the mitigation of natural disasters within the plantation sector based on the principles of sustainable agriculture. The research is grounded in the high vulnerability of plantation areas to natural disasters, which is attributable to weak law enforcement and the low level of compliance among business actors with environmental regulations. The study employs a normative legal research method, utilizing both a statutory approach and a conceptual approach. The findings indicate that the effectiveness of preventive legal mechanisms remains limited, despite the existence of various regulatory frameworks. The concept of sustainable agriculture, however, provides a strategic direction toward achieving a balance between production and environmental preservation. Accordingly, it is imperative to strengthen the existing regulatory framework in order to enhance the effectiveness of disaster mitigation efforts within the plantation sector.
