Notary's Liability Regarding The Deed Of Agreement For Sale And Purchase In Cases Of Dispute Between The Parties
Main Article Content
Abstract
A notary, as a public official, is authorized to make authentic deeds, including the Sale and Purchase Binding Agreement (PPJB). In practice, PPJB deeds often cause disputes between the parties, resulting in issues regarding the notary's own accountability. This study aims to analyze the notary's responsibility for the disputed deed, as well as the legal protection for the parties. The method used is normative legal research with a statutory and conceptual approach. The research results show that a notary is responsible if there are errors or negligence in formal or procedural aspects, but not for the substance of the parties' agreement. Therefore, a notary must act professionally and apply the principle of prudence.
